Terms of Use
1. These terms
Shmelvin is operated by Uziel Menetzir (“we”). By using Shmelvin you agree to these terms and to our Privacy Policy.
2. Who can use Shmelvin
You must be 18 or older. You talk on Shmelvin by starting a conversation and sharing its link, or by joining a conversation through a link someone shared with you.
3. How Shmelvin works
- Words disappear once they've been read. There is no history and no backup, and we can't restore anything. Don't use Shmelvin for anything you need to keep.
- A conversation ends an hour after the last activity in it — someone writing, typing or joining. Everything still waiting in it is then deleted, and it can't be reopened.
- Anyone can still photograph or record their screen. Shmelvin can't prevent that.
- Your account lives on your devices. If you lose all of them without a recovery email or passkey, we can't get your account back.
4. What you may not do
- Break the law, or help anyone else do so.
- Harass, threaten, intimidate or impersonate anyone.
- Share sexual content involving anyone under 18. We report it to the authorities.
- Share someone's intimate images without their consent.
- Send spam, or create accounts or conversations, or join them, automatically.
- Interfere with Shmelvin, try to get around its limits, or access other people's accounts.
5. Reports and moderation
You can report anyone you talk to. A report includes what you choose to include, and is read only by our designated reviewer. We may limit, suspend or close accounts that break these terms. If you think we got it wrong, write to support@shmelvin.com.
6. Your words
What you write is yours. You allow us to transmit it, and to store it as described in the Privacy Policy, only to run Shmelvin.
7. The service
We work to keep Shmelvin running and safe, but we provide it “as is”, without warranties, to the extent the law allows. We may change Shmelvin, or stop offering it, and will tell you in the app beforehand where we reasonably can.
8. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data or words, which Shmelvin by design does not keep. Shmelvin is free, and to the extent the law allows, our total liability to you is limited to ILS 100. Nothing in these terms limits liability that cannot be limited by law, or any rights you have as a consumer that cannot be waived.
9. Ending
You can delete your account at any time: Settings → Delete account. We may suspend or close your account if you break these terms.
10. App stores
If you got Shmelvin from the App Store or Google Play, these terms are between you and us, not Apple or Google. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Apple has no obligation to provide support or maintenance for Shmelvin.
11. Law
These terms are governed by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction. This does not take away any mandatory protection, or any right to bring a claim in the courts where you live, that the law of your country gives you as a consumer.
12. Changes and contact
If we change these terms, we'll update the date above, and tell you in the app if the change matters. Questions: support@shmelvin.com.

זהו תרגום של הנוסח האנגלי. למשתמשים בישראל, בסתירה בין הנוסחים, הנוסח העברי קובע.
1. התנאים האלה
את שמלווין מפעיל Uziel Menetzir („אנחנו”). השימוש בשמלווין הוא הסכמה לתנאים האלה ולמדיניות הפרטיות שלנו.
2. מי יכול להשתמש
צריך להיות בן או בת 18 ומעלה. מדברים בשמלווין כשפותחים שיחה ומשתפים את הקישור שלה, או כשמצטרפים לשיחה דרך קישור שמישהו שיתף.
3. איך שמלווין עובד
- מילים נעלמות אחרי שקראו אותן. אין היסטוריה ואין גיבוי, ואנחנו לא יכולים לשחזר שום דבר. אל תשתמש/י בשמלווין למשהו שצריך לשמור.
- שיחה מסתיימת שעה אחרי הפעילות האחרונה בה — כתיבה, הקלדה או הצטרפות. כל מה שעוד חיכה בה נמחק, ואי אפשר לפתוח אותה מחדש.
- כל אחד עדיין יכול לצלם או להקליט את המסך. שמלווין לא יכול למנוע את זה.
- החשבון שלך נמצא במכשירים שלך. אם כולם אבדו ואין אימייל לשחזור או מפתח גישה, לא נוכל להחזיר את החשבון.
4. מה אסור
- לעבור על החוק, או לעזור למישהו אחר לעשות זאת.
- להטריד, לאיים, להפחיד או להתחזות למישהו.
- לשתף תוכן מיני שמעורבים בו קטינים. אנחנו מדווחים על כך לרשויות.
- לשתף תמונות אינטימיות של מישהו בלי הסכמתו.
- לשלוח ספאם, או ליצור חשבונות או שיחות, או להצטרף אליהן, באופן אוטומטי.
- להפריע לפעולת שמלווין, לנסות לעקוף את המגבלות שלו, או לגשת לחשבונות של אחרים.
5. דיווחים ופיקוח
אפשר לדווח על כל מי שמדברים איתו. הדיווח כולל את מה שבחרת לצרף, ורק הבודק/ת שמינינו קורא/ת אותו. אנחנו עשויים להגביל, להשעות או לסגור חשבונות שמפרים את התנאים. אם לדעתך טעינו, כתוב/כתבי אל support@shmelvin.com.
6. המילים שלך
מה שכתבת שייך לך. את/ה מרשה לנו להעביר אותו, ולשמור אותו כמתואר במדיניות הפרטיות, רק כדי להפעיל את שמלווין.
7. השירות
אנחנו משתדלים לשמור על שמלווין פעיל ובטוח, אבל מספקים אותו „כמו שהוא” (as is), בלי אחריות, במידה שהחוק מתיר. אנחנו עשויים לשנות את שמלווין או להפסיק להציע אותו, ונודיע באפליקציה מראש כשזה אפשרי באופן סביר.
8. אחריות
במידה שהחוק מתיר, איננו אחראים לנזק עקיף או תוצאתי, או לאובדן מידע או מילים, שאותם שמלווין מלכתחילה לא שומר. שמלווין ניתן בחינם, ובמידה שהחוק מתיר, האחריות הכוללת שלנו כלפיך מוגבלת ל־100 ש״ח. אין בתנאים האלה כדי להגביל אחריות שאי אפשר להגביל לפי דין, או זכויות שלך כצרכן/ית שאי אפשר לוותר עליהן.
9. סיום
אפשר למחוק את החשבון בכל רגע: הגדרות ← מחיקת החשבון. אנחנו עשויים להשעות או לסגור חשבון שמפר את התנאים.
10. חנויות האפליקציות
אם הורדת את שמלווין מה־App Store או מ־Google Play, התנאים האלה הם בינך לבינינו, לא בינך לבין Apple או Google. Apple והחברות הבנות שלה הן מוטבות צד שלישי של התנאים ורשאיות לאכוף אותם. ל־Apple אין חובה לספק תמיכה או תחזוקה לשמלווין.
11. דין
על התנאים האלה חלים דיני מדינת ישראל, ולבתי המשפט המוסמכים בישראל סמכות שיפוט ייחודית. אין בכך כדי לגרוע מהגנה מחייבת, או מזכות להגיש תביעה בבתי המשפט במקום מגוריך, שהדין במדינה שלך מעניק לך כצרכן/ית.
12. שינויים ויצירת קשר
אם נשנה את התנאים, נעדכן את התאריך למעלה, ונודיע באפליקציה אם השינוי משמעותי. שאלות: support@shmelvin.com.
